Terms & Conditions

Maison La Jolla

Terms & Conditions

These Terms & Conditions govern your use of the Maison La Jolla
website and your purchase of products and services from us.

Effective Date: July 13, 2026

Agreement to These Terms

These Terms & Conditions constitute an agreement between you
and Maison La Jolla concerning your access to and use of our
website, online store, products, services, communications, and
related features.

By accessing the website, creating an account, submitting a
private-sourcing request, placing an order, or selecting a checkbox
indicating your agreement, you acknowledge that you have read,
understood, and agreed to these Terms & Conditions.

If you do not agree to these terms, do not use the website or place
an order.

About Maison La Jolla

Maison La Jolla is an online luxury resale boutique based in
La Jolla, California.

Our collection may include vintage, pre-loved, unused,
authenticated, and collectible handbags, accessories, jewelry,
and other luxury pieces.

References to “Maison La Jolla,” “we,” “us,” and “our” refer to
Maison La Jolla. References to “you” and “your” refer to website
visitors, customers, account holders, and individuals who
communicate or transact with us.

Eligibility

You must be at least 18 years old and legally capable of entering
into a binding agreement to make a purchase through our website.

By placing an order, you represent that the information you provide
is accurate, that you are authorized to use the selected payment
method, and that your purchase complies with applicable law.

We may refuse service, restrict access, cancel an order, or request
additional verification when reasonably necessary for legal,
security, fraud-prevention, or business purposes.

Accounts

You may be permitted or required to create an account to use
certain website features.

You are responsible for maintaining the confidentiality of your
login information and for activity occurring through your account.

You agree to provide accurate, current, and complete information
and to update it when necessary.

Notify us promptly if you believe your account or login information
has been accessed or used without authorization.

We may suspend or terminate an account that is used fraudulently,
unlawfully, abusively, or in violation of these terms.

Product Information

We make reasonable efforts to provide accurate descriptions,
photographs, measurements, condition information, and details
regarding included accessories.

Because many items are vintage or pre-loved, they may show signs
of age, use, handling, storage, repair, restoration, or previous
ownership.

These characteristics may include scratches, creasing, tarnish,
discoloration, patina, odor, fading, hardware wear, interior wear,
shape changes, or other imperfections.

Product photographs form part of the item description. Please
review all photographs, measurements, condition disclosures, and
included-accessory information before purchasing.

Colors may appear differently depending on lighting, photography,
screen settings, and device displays. Measurements are approximate.

Authenticity

Maison La Jolla represents the merchandise it sells as authentic
and evaluates each piece before listing.

The evaluation method may vary based on the designer, age,
category, available documentation, and characteristics of the item.

Third-party authentication, certificates, cards, receipts, or
other documentation will be identified in the listing when
included.

Our

Authenticity Policy

is incorporated into these Terms & Conditions.

Prices and Availability

Prices are displayed in the currency identified on the website and
may change without notice before an order is accepted.

Product availability is not guaranteed. Because many pieces are
unique or available in limited quantities, an item may sell before
your order is completed.

Adding an item to a cart, wishlist, or account does not reserve it.

We reserve the right to correct pricing, description, inventory,
technical, or typographical errors and to cancel an affected order.

If an order is canceled after payment has been collected, the
applicable amount will be refunded to the original payment method.

Orders

Your submission of an order is an offer to purchase the identified
item or items.

An automated order confirmation acknowledges receipt of your order
but does not necessarily constitute final acceptance.

An order may remain subject to payment authorization, inventory
confirmation, identity verification, fraud review, address review,
and other reasonable checks.

We may accept, decline, hold, or cancel an order in whole or in
part, including when:

  • An item is unavailable
  • A price or listing contains an error
  • Payment cannot be authorized
  • Identity or address verification is incomplete
  • Fraud or security concerns arise
  • Shipping or insurance is unavailable
  • The transaction appears unlawful or prohibited

Payments

Available payment methods are displayed during checkout.

Payment services may be provided by independent payment processors
subject to their own terms and privacy practices.

You authorize us and our payment providers to charge the total
amount shown at checkout, including applicable product prices,
taxes, shipping, insurance, duties, and other disclosed charges.

We may request identity, billing, address, or payment verification
before accepting or shipping an order.

You agree not to initiate a payment dispute or chargeback for an
issue that can reasonably be addressed through our customer-service
process without first contacting Maison La Jolla.

Nothing in this paragraph limits any nonwaivable rights available
through your payment provider or applicable law.

Taxes, Duties, and Fees

Applicable sales taxes may be calculated and collected during
checkout.

International customers are generally responsible for customs
duties, import taxes, brokerage fees, and other destination charges
unless otherwise stated.

These charges may be assessed by governmental authorities,
carriers, or customs agencies and are not controlled by Maison
La Jolla.

Shipping and Delivery

Shipping options, rates, and estimated timing may be displayed
during checkout.

Estimated delivery dates are not guaranteed. Carrier delays,
weather, customs, security reviews, holidays, and other events
outside our control may affect delivery.

Customers are responsible for providing a complete and accurate
delivery address and for monitoring tracking information.

Signature confirmation may be required.

Our

Shipping & Delivery Policy

is incorporated into these Terms & Conditions.

Returns and Refunds

Return eligibility, request deadlines, item-condition requirements,
final-sale categories, shipping responsibilities, and refund
procedures are governed by our

Returns & Refunds Policy
.

That policy is incorporated into these Terms & Conditions.

Please review it before completing a purchase.

Nothing in these terms excludes rights or remedies that cannot
legally be waived.

Order Cancellations

Orders begin processing shortly after they are submitted, so
cancellation cannot be guaranteed.

An order may not be canceled after it has been processed,
authenticated, packaged, specially sourced, reserved from a third
party, or transferred to a carrier.

Contact

info@maisonlajolla.com

promptly if you wish to request cancellation.

Private Client Sourcing

Submission of a private-sourcing request does not guarantee that a
requested item will be located, available, authenticatable, or
offered at a particular price.

Any sourcing estimate, photograph, description, or availability
update is subject to confirmation.

Before Maison La Jolla purchases, reserves, or commits to an item
on your behalf, we may require written approval, payment, a
deposit, or acceptance of additional sourcing terms.

Private-sourced and specially ordered pieces may be final sale as
disclosed before purchase.

Resale and Personal Use

Products are offered primarily for personal use and collection.

You may not use our website, photographs, product descriptions, or
inventory information to misrepresent an item, facilitate fraud,
create counterfeit listings, or falsely claim affiliation with
Maison La Jolla.

We may limit quantities or decline transactions that reasonably
appear connected to fraud, unlawful resale, or misuse of our
content.

Prohibited Conduct

You may not:

  • Use the website for an unlawful or fraudulent purpose
  • Provide false identity, payment, or delivery information
  • Attempt unauthorized access to an account or system
  • Interfere with website operation or security
  • Upload malicious code or harmful material
  • Scrape, copy, or harvest website data without permission
  • Impersonate Maison La Jolla or another person
  • Use our content to create misleading or counterfeit listings
  • Harass, threaten, or abuse our staff or other users
  • Violate intellectual-property or privacy rights

We may restrict or terminate access when we reasonably believe
these terms have been violated.

Intellectual Property

The Maison La Jolla name, branding, logos, website design, original
text, product descriptions, graphics, photographs, videos, and
other original content are owned by or licensed to Maison La Jolla
and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial
shopping purposes.

You may not reproduce, publish, modify, distribute, sell, license,
scrape, or commercially exploit our original content without prior
written permission.

Designer names and trademarks appearing in product listings belong
to their respective owners. Maison La Jolla is an independent
reseller and is not affiliated with, endorsed by, or sponsored by
those brands unless expressly stated.

User Submissions

You retain ownership of photographs, messages, reviews, and other
material you submit to us.

You grant Maison La Jolla permission to use submitted material as
reasonably necessary to respond to your inquiry, evaluate an item,
process a transaction, investigate a claim, provide customer
service, or comply with legal obligations.

We will not use customer photographs or reviews for public
marketing without permission when permission is legally required.

Reviews and Feedback

Reviews and feedback must reflect genuine experiences and may not
contain unlawful, fraudulent, defamatory, infringing, threatening,
or confidential content.

We may moderate content for relevance, spam, privacy, legality, and
compliance with these terms, but we will not require a customer to
provide a positive review as a condition of receiving ordinary
customer service.

Third-Party Services

The website may connect to third-party payment processors,
shipping carriers, social-media platforms, analytics providers,
authentication services, financing providers, or other services.

Maison La Jolla does not control those third parties and is not
responsible for their independent terms, privacy practices,
availability, security, or performance.

Your use of a third-party service may be governed by a separate
agreement between you and that provider.

Website Availability

We may modify, suspend, restrict, or discontinue any part of the
website or service at any time.

We do not guarantee uninterrupted, error-free, or continuously
available access.

Maintenance, technical failures, cyber incidents, hosting
disruptions, or circumstances outside our control may affect
availability.

Disclaimer of Warranties

To the fullest extent permitted by law, the website and its
content are provided on an “as is” and “as available” basis.

Except for express commitments stated in our policies or product
listings, Maison La Jolla disclaims implied warranties to the
extent such warranties may lawfully be disclaimed.

We do not warrant that the website will be uninterrupted,
error-free, secure, or free from harmful components.

Nothing in these terms excludes any warranty, right, or remedy
that cannot legally be excluded or limited.

Limitation of Liability

To the fullest extent permitted by law, Maison La Jolla will not
be liable for indirect, incidental, special, exemplary, punitive,
or consequential damages arising from website use, service
interruptions, third-party services, or transactions.

To the fullest extent permitted by law, our total liability for a
claim relating to a purchased product will not exceed the amount
you paid Maison La Jolla for the product giving rise to the claim.

These limitations do not apply where liability cannot legally be
limited, including certain liabilities involving fraud, willful
misconduct, personal injury, or nonwaivable consumer rights.

Indemnification

To the extent permitted by law, you agree to be responsible for
claims, losses, or expenses arising from your unlawful use of the
website, your violation of these terms, your infringement of
another person’s rights, or false information submitted by you.

This provision does not require you to indemnify Maison La Jolla
for its own unlawful conduct or for liability that cannot legally
be shifted to you.

Events Outside Our Control

Maison La Jolla is not responsible for delay or failure caused by
events reasonably outside our control, including natural disasters,
severe weather, carrier disruption, customs delay, labor dispute,
power or internet outage, government action, war, civil unrest,
cyberattack, epidemic, or supply interruption.

Governing Law

These Terms & Conditions are governed by the laws of the State
of California, without regard to conflict-of-law principles.

This provision does not deprive you of any mandatory consumer
protection available under the law of your place of residence.

Resolving Disputes

Before filing a formal legal claim, you and Maison La Jolla agree
to make a good-faith effort to resolve the issue informally.

Send a written description of the dispute, relevant order number,
requested resolution, and supporting information to:

info@maisonlajolla.com

Unless prohibited by applicable law, any court proceeding arising
from these terms or a transaction with Maison La Jolla shall be
brought in a court with proper jurisdiction in San Diego County,
California.

No arbitration agreement or class-action waiver is included in
these terms.

Severability

If any provision of these terms is determined to be invalid,
unlawful, or unenforceable, the remaining provisions will remain
in effect to the fullest extent permitted by law.

No Waiver

A failure or delay by Maison La Jolla in enforcing a provision
does not waive the right to enforce that provision later.

Assignment

You may not assign your rights or obligations under these terms
without our prior written consent.

Maison La Jolla may assign these terms in connection with a merger,
reorganization, financing, sale of assets, or transfer of the
business, subject to applicable law.

Entire Agreement

These Terms & Conditions, together with the Privacy Policy,
Returns & Refunds Policy, Shipping & Delivery Policy,
Authenticity Policy, product listing, checkout disclosures, and any
written special-order or sourcing terms, form the agreement
governing your transaction with Maison La Jolla.

If a specific written term provided for a private-sourced or
specially ordered item conflicts with these general terms, the
specific written term will control for that transaction to the
extent permitted by law.

Changes to These Terms

We may revise these Terms & Conditions periodically to reflect
changes in our business, website, services, or legal obligations.

Revised terms will be posted on this page with an updated effective
date.

Changes will apply prospectively unless applicable law permits
otherwise.
